Terms and Conditions

1. Scope

These terms and conditions apply to all events ("Mammutmärsche") organized by Mammutmarsch UG (haftungsbeschränkt), hereinafter referred to as the "organizer".

2. Organizer

The organizer of all Mammutmarsch events is Mammutmarsch UG (haftungsbeschränkt), Eichborndamm 167 G55, 13403 Berlin, represented by managing directors Bastian Kröhnert-Ferron and Kalle Eberhardt, commercial register: Amtsgericht (Berlin-)Charlottenburg, HRB 171429.

3. Event booking

The presentation of events in the online shop does not constitute a legally binding offer, but merely an invitation to register. By clicking the "Complete Order" button, you submit a binding registration for the event(s) listed on the order page. The event booking is concluded when we confirm and accept your registration by email immediately after receiving your payment of the corresponding participation fee.

4. Event cancellation

Should the event have to be cancelled due to force majeure (in particular natural events, epidemics, major technical incidents such as power outages or strikes), official orders, safety concerns, or other unforeseeable circumstances beyond the organizer's control, there is generally no entitlement to a refund of the participation fee, to the extent permitted by law. In such a case, the organizer will endeavor to offer participants either participation on an alternative date or a voucher equivalent to the participation fee paid.

5. Mandatory minimum equipment

To protect participants' health, participants are required to bring their own minimum equipment to the event. This is to ensure that everyone is prepared for the night, the weather, and any emergencies.

This mandatory minimum equipment includes: warm clothing (for the longer distances), sun and rain protection, a mobile phone with sufficient battery capacity and, if applicable, a power bank, a headlamp with sufficient battery life (for darkness on the route), and a water container (bottles or a hydration bladder).

6. Safety notices and disclaimers of liability for Mammutmärsche

Due to its length, the hiking route passes through both developed and natural sections. Depending on the weather, slippery passages may occur, ground may be eroded, or hidden obstacles such as roots, rubble, litter, or similar may appear. Even in dry weather, the organizer cannot rule out individual hazards along the route. All participants are responsible for their own sure-footedness; the organizer assumes no liability for any damage resulting from falls or sprains.

The route may also pass through forested areas. Many forested areas are damaged by storms, drought, pest infestation, or tree disease. Even despite prior hazard assessment and coordination with authorities, associated risks (such as falling branches or falling trees) cannot be completely ruled out. Neither the organizer nor the forest owner assumes any liability for this. Furthermore, neither the organizer nor the forest owner assumes any liability for abiotic hazards (such as storms and thunderstorms, snow and ice, heavy rain and erosion, fire and forest fires), biotic hazards such as fox tapeworm, oak processionary moth, or tick bites and resulting illnesses, or other hazards such as possible allergic reactions, poisoning from eating wild berries, fruits, or mushrooms, or injuries from spraining an ankle, slipping, or tripping.

Sudden drops in temperature or getting wet (rain, sweat) can lead to hypothermia. Likewise, heat or strong sun exposure can lead to overheating ("heatstroke") and sunburn. The organizer issues notes on mandatory equipment at least two weeks before the start of the event, recommending, for example, bringing warm clothing as well as suitable rain and sun protection. Participants are themselves obligated to check the weather forecast for the day of the event and to adjust both their clothing and their behavior accordingly. Given the duration of the event, the organizer generally recommends preparing for cold, wet, and hot conditions alike.

In strong wind, all participants are required to take responsibility for their own safety and to seek shelter from flying objects immediately. Extreme caution is required, especially in forested sections, and suitable shelter should be sought quickly in the event of an impending storm. The organizer reserves the right to reroute particularly critical sections of the route at short notice or to close them entirely for the duration of the storm. The organizer assumes no liability for damage caused by participants' recklessness or failure to follow the organizer's instructions.

In the event of a thunderstorm, the general safety rules for behavior outdoors apply. If caught by a thunderstorm in open terrain, a hollow should be sought where one can crouch down. There, one should crouch on an insulating surface such as an empty backpack or a sleeping mat and wrap one's arms around one's legs. One should not lie down, as this presents too large a target area for lightning. In forests, one should try to reach a clearing or the edge of the forest, crouch down there, and make oneself as small as possible. Trees offer no protection from thunderstorms — on the contrary, lightning strikes seek out high points, including antennas, towers, masts, or tall trees. The well-known saying "seek beeches, avoid oaks" is simply false. If groups are caught by a thunderstorm, they should spread out, as this also reduces the target area in the event of a possible lightning strike. Umbrellas, hiking poles, tent poles, bicycles, and other metal parts present a good target for lightning and should be kept away from the body. Here too, the organizer reserves the right to reroute certain sections of the route at short notice, to close them entirely for the duration of the thunderstorm, or to interrupt the event at short notice.

For longer distances and hiking in the dark, self-provided lighting of the route by means of a headlamp or flashlight is essential and is also part of the mandatory equipment to be carried. The organizer assumes no liability for obstacles on the ground or at body height that are easily overlooked due to poor lighting conditions. Participants are required to carry spare batteries and spare lamps. If these are lost or become unusable, help from other participants should be requested immediately.

Participants are responsible for ensuring adequate nutrition for the respective distance themselves. Participants are required to carry at least 2 liters of fluid with them. The mandatory equipment notices issued by the organizer at least two weeks before the start of the event also apply. Although the organizer sets up suitable refreshment stations along the route, participants are nevertheless responsible for meeting their own energy needs, especially in the case of individual diets. The organizer assumes no liability for any health damage caused by dehydration or other deficiencies. Likewise, the organizer assumes no liability for allergic reactions to the food provided at the event.

There must be no health concerns whatsoever against participating in a long-distance hike such as the Mammutmarsch. In the case of pre-existing conditions, e.g. of the cardiovascular system, prior consultation with the treating physician is strongly recommended. Physical fitness and adequate training before the event are the basic requirements for successful participation. The organizer is not liable for health damage attributable to the high level of physical strain. Participants are themselves responsible for their health before, during, and after the event. The organizer assumes no liability for health risks to participants during the event. For minors under 18 years of age, parents/legal guardians must confirm in writing before the start of the event that their child is medically able to participate in the event (see also point 7).

The organizer reserves the right to change the route, the start, and/or the course marshals, even at short notice, if this appears necessary at the organizer's reasonable discretion. Likewise, the organizer reserves the right to adjust start times, start group sizes, and comparable framework conditions. The burden on participants will be kept as low as possible in doing so. Spectators may be excluded from the event if they could jeopardize its smooth running.

7. Minors

As a rule, a Mammutmarsch event is not tailored to the needs of children and young people. This applies to route selection, hiking duration, and available refreshments alike.

The organizer explicitly points out that long-distance hikes can place a particular strain on the bodies of adolescents. In particular, joints, soft tissue, and growth plates can suffer pain and, in the worst case, long-term injury as a result of excessive strain. The strain limits of children and young people are highly individual. The organizer recommends only hiking distances over 30 km from the age of 12. In general, the following should always apply: for children, fun should come first.

Age information must be entered truthfully at registration. The organizer reserves the right to check age information by inspecting photo ID at check-in.

7.1 Guidelines for the distances: 30/42/50/55/60 km excl. night marches

Children aged 7 and above are eligible to start under the following conditions:

  • Minors under 18 years of age are only eligible to start when accompanied by a parent/legal guardian or an adult companion.
  • Parents/legal guardians or adult companions must complete the same route as the minor.
  • Duty of supervision remains with the parent/legal guardian/companion and explicitly not with the organizer. This applies in particular to minors' compliance with road traffic regulations.
  • Parents/legal guardians or adult companions undertake to ensure that the minor consumes adequate nutrition, particularly with regard to carrying drinking water.

The following documents must be submitted on-site at registration:

  • a fully completed and signed form "Declaration of consent, medical fitness, and disclaimer of liability for minors", to remain with the organizer
  • presentation of a valid photo ID of the accompanying person

7.2 Guidelines for the distances: 75/100 km & night marches

Young people over 16 and under 18 years of age are eligible to start under the following conditions:

  • Minors over 16 and under 18 years of age are only eligible to start when accompanied by a parent/legal guardian or an adult companion.
  • Parents/legal guardians or adult companions must complete the same route as the minor.
  • Duty of supervision remains with the parent/legal guardian/companion and explicitly not with the organizer. This applies in particular to minors' compliance with road traffic regulations.
  • Parents/legal guardians or adult companions undertake to ensure that the minor consumes adequate nutrition, particularly with regard to carrying drinking water.

The following documents must be submitted on-site at registration:

  • a fully completed and signed form "Declaration of consent, medical fitness, and disclaimer of liability for minors", to remain with the organizer
  • presentation of a valid photo ID of both the accompanying person and the minor

8. Other limitations of liability

Participants bear civil and criminal responsibility for all damage caused by them, including damage caused by them to third parties. Participants release the organizer as well as all persons involved from any liability for accidents or damage caused by them, to the extent permitted by law.

The organizer is only liable for damage caused intentionally or through gross negligence by us, our legal representatives, employees, or vicarious agents, or for injury to life, body, or health resulting from a negligent breach of duty by the organizer, its legal representatives, or vicarious agents.

In the event of a slightly negligent breach of a material contractual obligation (cardinal obligation), the organizer's liability is limited to foreseeable damage typical for this type of contract. In the event of a slightly negligent breach of ancillary obligations that are not material obligations of the contract, the organizer is not liable. Material obligations are those whose fulfillment enables the proper performance of the contract in the first place and on whose observance you, as the contracting party, may rely.

Any further liability is excluded.

The above limitations of liability do not apply to damage for which we cannot limit our liability under mandatory statutory provisions. In such cases, the general statutory provisions apply.

To the extent our liability is excluded or limited, this also applies to the personal liability of our employees, staff, representatives, and vicarious agents.

9. Instructions of the organizer

The organizer's instructions must always be followed. Failure to do so may result in the participant's exclusion from the event; in this case, any claim to a (partial) refund of the event fee is excluded.

The organizer reserves the right to exercise house rules within the event areas. Wearing anti-constitutional or discriminatory clothing and brands will result in exclusion from the event. Discriminatory remarks and abusive behavior will likewise result in exclusion from the event.

10. Compliance with road traffic regulations

Participants must comply with road traffic regulations during the event. The events largely take place on routes that are not closed off, and participants act as independent road users who are themselves responsible for their own conduct.

11. Right of withdrawal

Since participation in a Mammutmarsch constitutes a leisure activity with a specific date for the performance of the contract, there is no right of withdrawal for online bookings.

Bookings may nevertheless be cancelled subject to the conditions set out in point 12.

12. Cancellation

Cancellation of participation is generally not possible after registration, payment, confirmation, and acceptance. Exceptionally, participants may withdraw if participation is not possible for health reasons and a medical certificate is submitted by email to support@mammutmarsch.de at the latest on the day of the event, before it starts. In justified individual cases, a refund is also possible upon submission of a certificate submitted retrospectively for the event period; please also contact support@mammutmarsch.de by email for this. In this case, participants may choose to either receive a refund of the participation fee, less a processing fee of €15, or participate in the following year's event without paying again.

13. Photo and video recordings

Photo and video recordings (with sound) are made at Mammutmarsch events. These may be published on social media, in print media, or by cooperation partners (third parties).

Purpose: the recordings may be published on the controller's website and social media channels and those of its cooperation partners, as well as for press releases, PR, and in broadcast, TV, and print media.

Duration of processing: the recordings are only stored for as long as necessary for the aforementioned purpose. They are then deleted.

Legal basis: processing takes place based on the legitimate interest of the controller in documenting the event it has organized in pictures and/or on film and in reporting positively about it to a wider public (Art. 6(1)(f) GDPR).

Participants' rights: participants have the right to information, rectification, erasure, restriction, objection, and data portability. They also have the right to lodge a complaint with the data protection authority. To exercise this right, participants should contact datenschutz@180-datenschutz.de directly.

13. Applicable law

Regardless of the event location, German law is deemed to apply. However, participants are not deprived of the protection afforded to them by the mandatory provisions of the law of the country where the event takes place.
